Everything you need to know about marriage in Sao Tomé and Principe 01

Sao Tomé and Principe is an island country in central Africa. The country consists of two archipelagos around the two main islands of Sao Tomé and Principe. Every year, thousands of marriages are performed in this country by native Sao Toméans and foreigners from other countries. Marriages in Sao Tomé and Principe are solemnized in either civil, religious, or traditional ceremonies. However, it is possible to have multiple marriages, such as in cases where couples would like to perform a civil and religious marriage. These types of marriages are recognized and protected by law, and all civil marriages performed are internationally valid. Most marriages performed in the country are traditional or "customary" marriages.

Formal civil marriages are only common among elites who live in urban areas. Common-law marriages are also recognized in Sao Tomé and Principe. In a lot of regions and communities, couples often do not go through all the required formalities before deciding to live together as husband and wife. Even though this type of marriage is not formally legalized or recognized by the government, it is still widely practiced. In Sao Tomé and Principe, arranged marriages used to be very popular. The norm was for families to search for potential brides for their son, who must have reached the age of marriage.

In some families, the parents of the bride and groom often agree to marry off their children, even when they are unborn or just infants. It is seen as a way of strengthening the bond between both families. Other families may look for brides based on qualities like beauty, level of education, family background, etc. There is a prevalent rate of child marriage in this country. The legal age for marriage in Sao Tomé and Principe is 18 years for both male and female spouses. However, exceptions are allowed. Female and male spouses between the ages of 14 and 18 and female and male spouses between the ages of 16 and 18 may be allowed to marry provided they have parental, guardian, or court’s consent and approval.

Nevertheless, most cases of minors getting married are the result of customary marriages. About 35 percent of all marriages in the country are entered into by spouses who have not reached the age of 18. Child marriages before the age of 15 amount to 8 percent of all marriages in the country. As you read on, you will find out more about the types of marriages in Sao Tomé and Principe as well as their various laws and rights.

Civil marriages

Civil marriages performed in Sao Tomé and Principe are recognized in the country and other parts of the world. This type of marriage is performed by an authorized registrar in a civil registry office. To contract a civil marriage in Sao Tomé and Principe, there are steps that must be followed by both spouses, as well as documents they are required to submit. To curb the number of child marriages in the country, a lot of attention is paid to the minimum age of marriage, especially when such marriages are recorded in the civil registry. Both partners must be at least 18 years old to get married civilly.

Under special circumstances, male and female spouses aged 16 and 14 may be allowed to marry with consent as stated above. Both partners must state that they are marrying of their own free will and consent. The application for a marriage license must be done in person at the registry office. The registrar will then provide an application form as well as a list of documents that must be attached to it. The application form must be completed by the couple with their signature.

The documents submitted must be certified copies, and they must include current and accurate information about the status of both partners. Foreign spouses may be required to submit some additional documents that are not typically requested from Sao Toméans. This includes a proof of arrival or residence in the country and a certificate of no impediment to marry. The latter document must be submitted for the purpose of showing that a foreign spouse is not facing any legal prohibitions that may prevent them from getting married abroad, such as marriage age or marital status. The documents obtained from foreign countries must be translated into Portuguese, as this is the official language of Sao Tomé and Principe.

Furthermore, these documents must also include an apostille with an authorization seal or stamp. There are generally no requirements for blood tests or physical examinations. However, spouses entering a marriage must both be of sound health and mind. They must have the mental capacity to make decisions on their own and clearly state that they are getting married as a result of their own free will. The registrar will fix a date for the marriage ceremony after the license is issued to the couple. The paperwork couples are required to submit is stated below.

  • A national ID card or a valid passport
  • Government-issued birth certificates
  • Proof of arrival and residence in Sao Tomé and Principe may be required from foreign spouses.

There is usually a mandatory premarital counseling session that may include multiple classes that run for up to a month or more prior to the marriage. It is usually organized by the priest.
